If you would like more information regarding traffic accident risks, the National Highway Traffic Safety Administration produces an incredible amount of data regarding traffic risks and dangers.
Since 2006 and until 2015, we saw a slow but steady decrease in the number of traffic-related fatalities in Georgia. However, as depicted below, the number of traffic fatalities in Georgia has increased dramatically in the last two years. This is a disturbing trend on many levels. The overall number of DUI-related traffic deaths appears to be diminishing, but we are continuing to see little affect on the number of traffic deaths.
Most injuries resulting a car wreck are paid by an insurer. One of the most critical aspects of any car accident case is understanding the limits of available coverage. Once we understand the limits of available coverage, we think work towards maximizing the recovery from the insurer that holds the insurance policy.
Transcript – The importance of disclosing prior accidents and claims to your car accident lawyer
If you’ve been hurt in an accident, one of things that you really need to be aware of is that you mm — absolutely must tell your personal injury lawyer all of your prior medical history, any [new] prior accidents that you’ve been involved in that may have involved injuries, any part of your body, but particularly the parts of your body that are related to injuries that you incurred in this accident or this incident. If you don’t do that, then what you’re gonna realize really very quickly is that the insurance company probably knows about those prior claims or prior claims of injuries that you might have had, and they’re going to very, very quickly discredit everything that you’re claiming in this case, or they’re going to diminish the value of – of the actual claim that you have here, so be very careful about providing that information, and make sure that you’re providing complete and accurate information to your attorney. If you have any questions about your case, feel free to call me. My name is Ben Sessions, and I am an Atlanta car accident lawyer. My phone number is (470) 225-7710 (Atlanta) and (478) 254-2665 (Macon). Thank you.
One of the most worrisome/bothersome things that a person can experience following a car accident is an insurer’s refusal to accept responsibility after an accident. Do not be upset if you are in this situation.
Some insurers deny responsibility for accidents in which it is clear that their insured caused the wreck. Some insurers deny responsibility for the injuries you have suffered based upon their belief that the you were not injured in the accident. Insurers can refuse to accept responsibility on any basis that they wish to, but there can be a price to be paid for this ridiculous action. If your personal injury lawyer understands the law and how to use the law to your benefit, the insurer can be held responsible for these actions.
One of the most common questions that people ask us after an accident is, how much money it is that they’ll actually recover from the accident. That is, how much money it is that an insurer is going to pay them for the injuries and losses that they’ve suffered. To answer this question, you need a lot more information than just how much wages or how much medical expenses that the person has actually incurred. You need to know how much actual policy coverage is at play. That is, how much money and insurance does the at-fault party have? If you’d like to discuss with us how it is that we can arrive at an estimate of the amount of money that you might recover following your accident, feel free to call us. My name is Ben Sessions. My phone number is (470) 225-7710 (Atlanta) and (478) 254-2665 (Macon). Thank you.
Video: “Are insurers really looking to deny your claim?”
One of things that people really don’t realize or appreciate after they’ve been involved in a — in an accident, is how strategically it is that insurers actually approach these cases and their claims. The blog posts that accompanies this video actually discusses and lays out a little bit for you, to give you a little bit of flavor about how it is that insurers think about defending cases and how it is that they select ex — experts, in an effort to try to deny your claim or diminish your claim. So, as you’re dealing with your case, one of the things that you really need to think about early on, is getting a well-qualified personal injury lawyer involved in your case, so that they can protect your inter — your interests, because one of the things that you need to know as you’re approaching this claim or this case, is that the insurance company is gonna do everything that they can to diminish or deny your claim outright, if they can. If you have questions, feel free to call me. My name is Ben Sessions. I am an Atlanta car accident lawyer, and my phone number is (470) 225-7710 (Atlanta) and (478) 254-2665 (Macon). Thank you.
One of the things that’s really difficult for people to understand is what the timeline is for actually resolving their personal injury case. Whenever you have any type of medical treatment and liens that are created by virtue of a hospital lien, insurance subrogation lien, or a Medicare/Medicaid lien that may arise from payments that are made on your behalf following your accident, following your treatment, by some other provider, you have to resolve those types of liens in order to actually get your dispersion or your settlement out of your case. So, whenever we’re going through this process, you need to know that resolving those liens that may exist as a result of someone paying for your medical care on your behalf is one of the most time-consuming parts of your case and what we really need to do is on the front end, prior to accepting any sort of settlement, begin negotiations with those payment providers to make sure that the amount of money you actually receive is going to be netted into your pocket. So, you want to make sure, before you actually resolve your case, how much money is going to be reimbursed by those providers before you actually agree to accept any sort of amount in resolving the actual claim for the case that you have. If you have any questions about reimbursements and settlement processes and your personal injury case, feel free to call me.
