Our client was charged with DUI after she was involved in an accident in which she allegedly ran through a red light. Prior to the accident, our client had been followed by another driver who claimed that she was swerving continuously. Our admitted drinking previously and submitted to a preliminary breath test which was positive for the presence of alcohol. Our client refused field sobriety tests and the state-administered breath test. The Jury found our client Not Guilty of DUI and Failure to Obey a Traffic Control Device.
Our client showed remarkable faith in seeing this case through a trial. Within the last 10 years, she had been convicted a DUI. In Gwinnett County, a defendant can face considerable jail time on a 2nd DUI conviction, particularly after a jury trial.
