Do not sign anything relating to your car wreck until you speak with a car accident lawyer that is knowledgeable about Georgia insurance law and how any release that you may sign will impact your ability to obtain a full recovery for your injuries. So, you must receive full compensation when you receive a payment from an insurer following your car accident.
After a car crash, many people are justifiably concerned with taking care of property damage claims and getting their vehicle repaired. Unfortunately, many people involved in motor vehicle accidents also give recorded statements to insurers that are used against them to deny or diminish the value of their claims. If you have been injured in a motor vehicle accident, do not let an insurer take advantage of your by taking a quick recorded statement before you have had an opportunity to speak with a personal injury attorney. They do not provide you with a disclaimer regarding the risks associated with these recorded statements, but they do try to use them against you later. Before you speak with an insurer, get the legal representation that you are entitled to. Let us take the steps necessary to help you get a fair settlement and fair compensation for the injuries and losses you’ve suffered as a result of someone else’s negligence and/or recklessness.

How long do I have to file a lawsuit for injuries caused by a car accident in Georgia?
Generally, a case brought to recover for injuries from a car accident must be filed within 2 years from the date of the car accident:
Except as otherwise provided in this article, actions for injuries to the person shall be brought within two years after the right of action accrues, except for injuries to the reputation, which shall be brought within one year after the right of action accrues, and except for actions for injuries to the person involving loss of consortium, which shall be brought within four years after the right of action accrues.
O.C.G.A. § 9-3-33.
There has a been a remarkable amount of litigation over how the statute of limitations should be calculated. Unfortunately, lawyers and parties to accidents frequently procrastinate. Do not chance your case and your ability to recover for injuries following a car accident based upon the statute of limitations.
For example, consider the case below. While the plaintiff was able to maintain his claim, there was a substantial amount of risk of jeopardizing his/her claim by waiting until the last minute to file the case:
A motion to dismiss barred claims is properly granted “[w]hen a complaint shows on its face that the statute of limitation has run and there is no further showing by amendment or by affidavit that a tolling of the statute is possible.” (Citations and punctuation omitted.) Cooper v. Commercial Union Ins. Co., 192 Ga.App. 815, 816(1), 386 S.E.2d 551 (1989); Bailey v. Kemper Group, 182 Ga.App. 604, 607, 356 S.E.2d 695 (1987). Gullatt’s complaint alleges that he was injured when he was struck by an automobile on April 1, 1998. Gullatt concedes that Georgia law required him to file his personal injury action “within two years after the right of action accrue[d].” OCGA § 9-3-33. The date two years after April 1, 1998, that is, April 1, 2000, fell on a Saturday. See OCGA § 1-3-1(d)(3) (“when a period of time measured in … years … is prescribed for the exercise of any privilege or the discharge of any duty, the first day shall not be counted but the last day shall be counted”). When “the last day falls on Saturday or Sunday, the party having [any] privilege or duty shall have through the following Monday to exercise the privilege or to discharge the duty.” OCGA § 1-3-1(d)(3). See Loveless v. Grooms, 180 Ga.App. 424, 425, 349 S.E.2d 281 (1986). Gullatt filed his complaint on April 3, 2000, the Monday following April 1, 2000. As a matter of law, Gullatt’s complaint was timely filed.
Gullatt v. Omega PSI PHI Fraternity, Inc., 248 Ga. App. 779, 779, 546 S.E.2d 927, 928-29 (2001).

What Can I Do to Help My Macon Car Accident Lawyer?
- Seek Medical Attention. After a car accident, your body can be in a state of shock, which could keep you from feeling pain at first. You could also sustain injuries that might not appear until days after the accident. Some symptoms to look out for are pain, numbness, discomfort, dizziness, etc. If any of these are felt, you should seek medical attention from a doctor immediately. Not only will this help you health and help you recover better and faster, but it will also strengthen you personal injury claim. The longer you wait to seek medical attention, the harder it is to prove that these injuries resulted from the accident itself. So always make sure to go to the doctor immediately following the accident. People frequently try to endure severe pain after car accidents, rather than seeking treatment. Here are some of the most common injuries that people suffer in car accidents.
- Take detailed notes and photos. When you go see a doctor, chiropractor, physical therapist, or any other health professional, always write down their contact information. Also, keep very detailed notes on any injuries you may have suffered from and any medical treatment given to you. This also includes keeping receipts for medications that you may have been prescribed or any assistive devices such as crutches that may have been needed. Make sure to keep record of any contact you have with your medical health professional during your course of treatment such as emails and telephone calls. Lastly, keep all of your medical bills and receipts you received. All of this will help strengthen your case.
- Take photos of your injuries. If possible, you or a family member or a friend should take pictures of all your injuries. This will be useful if the insurance company is giving you trouble getting a settlement or if you decide to hire a personal injury attorney. Photographic evidence will become very valuable in either of those situations.

You never know when a simply mistake will land you outside the law. This can leave you feel helpless.
When this happened to me I reached out to Ben Sessions. He came on board giving me confidence and assurance. He was quick to answer my question and keep me at ease.
In the court room he was professional and concluded the matter at hand successfully.
Had he not been there for me the way of life I know would have changed greatly. This was very important due to the fact my job was in jeopardy.
If you find yourself in legal turmoil I recommend Ben Sessions.

A lot of people have a lot of difficulties discussing their injuries with medical providers or with the insurance company for the other party. I’ll tell you that there’s really no secret or silver bullet dealing with these issues. A lot of people have a tendency to either understate their injuries or to overstate them, in which event the insurance company tends to look at them a malinger or someone who is just exaggerating the injuries that they’ve had. What I try to do is, is spend a lot of time with the client to actually understand what is going on with them. That way we can discuss what the upsides and downsides are to the way in which they are actually portraying your injuries. I believe that as you talk with clients, a lot of times you can develop a really effective plan as to how it is these questions should be addressed, about the insurance company, whenever they’re asking you about that, and possible another lawyer that they were actually entered into litigation involved in the case. If you have questions about your case, please don’t hesitate to call me. My name is Ben Sessions, my office number is 478-254-2665. Again, 478-254-2665, thank you.

One of the questions that clients ask me is that, if they are involved in an accident where their car’s totaled out, do they need to continue paying the premiums that are due under the policy of insurance they have at this time of the accident. The answer to that, the short answer is, no, you do not need to continue paying towards the premiums that were otherwise do you in the policy for the car that was totaled out in an accident that you were involved in. The obligations of your insurance company to you, are fixed as of the date of the accident. That is, they don’t go away simply because you fail to make the premium policy payment at a future . So, you can go ahead and cancel that policy, get a new policy in place at the point in time which you replace the car, or if you get a new car after the accident. If you have any questions about your accident or if you’d like to discuss other obligations that you might have following an accident, feel free to call me.
